ORDINANCE _________________
AN ORDINANCE relating to the City Light Department; authorizing the acceptance of eight deeds to lands in King County, Skagit County, and Snohomish County, Washington, to be set aside as salmon habitat pursuant to the Early Action Proposal and as setforth in Ordinance 120618.
WHEREAS, Ordinance 120618, authorized the Superintendent of City Light and the Director of Seattle Public Utilities, within and subject to appropriation authority, to negotiate for and purchase certain parcels of land in the Skagit River and theTolt/Snoqualmie River watersheds; and
WHEREAS, the parcels identified for purchase in Ordinance 120618 met the purposes of the Early Action Program, which intended to prevent degradation of otherwise pristine land, to enhance prime habitat that would otherwise not be enhanced, and to helpbuild a network of prime habitat locations in partnership with other interested parties for purposes of salmon recovery in these watersheds and the region; and
WHEREAS, the above referenced real property transactions require acceptance of the deeds by City ordinance; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS:
Section 1. That the Statutory Warranty Deed executed by Seattle Timber Company, Inc., a Washington corporation, on December 29, 2000, as Grantor, recorded under Skagit County Recording Number 200101110102, conveying approximately 130 acres locatedalong the Suiattle River, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 2. That the Statutory Warranty Deed executed by Claude Stephens and Carolyn Kay Stephens, husband and wife, on December 19, 2001, as Grantors, recorded under King County Recording Number 20020409000681, conveying approximately 20 acres locatedalong the Tolt River, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 3. That the Statutory Warranty Deed executed by J.J. Latuseck and Ina Latuseck, husband and wife, on January 10, 2002, as Grantors, recorded under King County Recording Number 20020122001252, conveying approximately .6 acres located along theTolt River, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 4. That the Statutory Warranty Deed executed by J.J. Latuseck and Ina Latuseck, husband and wife, on January 10, 2002, as Grantors, recorded under King County Recording Number 20020122001253, conveying approximately 3.2 acres located along theTolt River, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 5. That the Statutory Warranty Deed executed by Eileen Neilson, as her separate estate, on December 18, 2001, as Grantor, recorded under Skagit County Recording Number 200202200087, conveying approximately 39.9 acres located along the SaukRiver, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 6. That the Statutory Warranty Deed executed by Daniel L. Hinds and Wanda M. Hinds, husband and wife, on January 28, 2002, as Grantors, recorded under Skagit County Recording Number 200202010140, conveying approximately 14 acres located alongthe Skagit River, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 7. That the Statutory Warranty Deed executed by Gary A. Corra, as his separate estate, on July 24, 2002, as Grantor, recorded under King County Recording Number 20020815001448, conveying approximately .5 acres located along the Tolt River, ishereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 8. That the Statutory Warranty Deed executed by Michael Failla, as his separate estate, on September 25, 2002, as Grantor, recorded under Snohomish County Recording Number 200209260676, conveying approximately 113 acres located along the SaukRiver, is hereby accepted and the real property conveyed therein is placed under the jurisdiction of the City Light Department.
Section 9. Any act pursuant to the authority and prior to the effective date of this ordinance is hereby ratified and confirmed.
Section 10. This ordinance shall take effect and be in force thirty (30) days from and after its approval by the Mayor, but if not approved and returned by the Mayor within ten (10) days after presentation, it shall take effect as provided by MunicipalCode Section 1.04.020.
